Contractor Law Requirements - State of Michigan
The state of Michigan has always required painters in the state to be licensed if for residential painting work over the contract amount of $600.
Recently, the state of Michigan made changes to the law and now requires (among other requirements) paint contractors:
- that all qualifying officers for each corporation, LLC or partnership must be individually licensed as well as the company itself
- 60 hours of pre-license education must be completed before applying for a license.
- continuing competency activities requirement to retain a license.
- fines for the first offense of operating without a license were increase to a fine of up to $25,000 or prison term or not more than one year - or both.
- upon completion of the pre-license requirements, the applicant must pass a 100 question test covering painting and decorating and business law (including construction lien law).

The purpose of contractor licensing has always been the goal of consumer protection. Every state that has licensing requirements, does so to prevent homeowners from untrained and unqualified or "fly by nighters" from scamming homeowners.
Most states have a requirement for painters to become licensed before holding themselves out to the public as "painters". There is no national law or licensing procedure, the laws are made on a state to state basis. Laws from state to state differ on pre-license work experience required and education / training in the trade before applying for a license.
In the states where licensing is required, there is often a continuing education requirement for the purpose of keeping the contractors up to date with contracting law and trade practices.

A Good Thing
I am very much a libertarian and would like to see minimal government interference in the civil liberites and freedoms of American citizens. I will say that minimal regulation to me seems reasonable. A homeowner can easily be hood-winked by a fast talking contactor who using painter-jargon, railroads the homeowner into a job they neither need or want. Often the work is done by painters who are not qualified to do the job to add insult to injury.
Some reasonable degree of pre-license competancy and training requirements for licensing seems at least to this painter, as reasonable.
All contractors should become aware of their own state requirements for licensing and abide by the laws of the state - if for no other reason than to stay out of trouble.
